These terms govern your use of www.twodoorproperty.com. They are issued in English. They do not govern any estate agency appointment, which is dealt with separately in a signed authority to act.

1. Who we are

Two Door is a Penang real estate brand of Property Talk Realty Sdn Bhd (Company Registration No. 1487104-W), a real estate firm registered with the Board of Valuers, Appraisers, Estate Agents and Property Managers Malaysia (Firm No. E(1)2038). Two Door is a trading name and not a separate legal entity. In these terms, “we”, “us” and “our” refer to Property Talk Realty Sdn Bhd trading as Two Door, and “you” refers to any person accessing or using www.twodoorproperty.com (the “website”).

2. Acceptance of these terms

By accessing or using the website you agree to these terms. If you do not agree with them, please do not use the website. We may amend these terms from time to time by posting the revised version on this page with an updated date. Amendments take effect when posted, and your continued use of the website after that point constitutes acceptance of the revised terms. We recommend that you review this page periodically.

3. Property listings and particulars

Property particulars published on the website, including asking prices, land and built-up areas, tenure, title category, bedroom and bathroom counts, floor plans, photographs, videos and descriptions, are supplied to us by property owners, co-broking agents, developers and other third parties. While we take reasonable care in presenting them, we do not independently verify every particular and we do not warrant that any of it is accurate, complete or current.

Listings are provided for general information only. They are not an offer, a representation or an invitation to treat, and they do not form part of any contract. All properties are offered subject to availability, to prior sale or letting, and to change or withdrawal without notice. A listing may remain visible for a short period after a property is no longer available.

Before you commit to any transaction, you must satisfy yourself as to the accuracy of every particular that matters to you, including title, tenure, encumbrances, restrictions in interest, land area, built-up area, planning status, renovation approvals and outgoings. You should do this through your own solicitor, registered valuer, licensed surveyor, banker or other qualified professional. Photographs and videos are illustrative and may have been taken at an earlier date, may be digitally enhanced, may show staging or furnishing that is not included in the sale, and may not reflect the current condition of a property.

Where a map or pin is shown, the location is approximate and is displayed at that level of precision deliberately, in order to protect the privacy and security of the occupants. It should not be relied on as the exact position of any property or boundary.

4. Recently sold and transacted information

Any transacted, sold or historical price information shown on the website is indicative only. It is drawn from our own records and from sources we believe to be reliable, it may be rounded, delayed, incomplete or subsequently revised, and it may exclude rebates, incentives, furnishing, renovation costs or other terms that formed part of the transaction. It is published to give a general sense of the market. It is not a valuation, an appraisal, a market forecast or a representation as to what any property will achieve, and it must not be relied on for that purpose.

5. Free Valuation and indicative price opinions

Where the website invites you to request a “Free Valuation”, what we provide is an estate agent’s indicative opinion of likely market price, given for marketing and discussion purposes only.

It is not a valuation within the meaning of the Valuers, Appraisers, Estate Agents and Property Managers Act 1981. It is not prepared by a registered valuer, it is not supported by a valuation report or inspection to professional valuation standards, and it carries no professional valuation opinion. It must not be submitted to or relied on by any bank or financial institution for loan or refinancing purposes, or used for probate, taxation, insurance, matrimonial, accounting, court or any other formal or statutory purpose.

An indicative opinion is a view formed at a point in time from the information made available to us, and market conditions change. If you require a formal valuation, you must engage a valuer registered with the Board of Valuers, Appraisers, Estate Agents and Property Managers Malaysia, and we are happy to point you towards one. To the fullest extent permitted by law, we accept no liability for any decision taken in reliance on an indicative price opinion.

6. Guides, FAQ and general information

Our Buyer, Seller, Foreigner and Must Know guides, our FAQ and any other explanatory material on the website are published as general information about the Malaysian property market. They are not legal, financial, taxation, lending, valuation or investment advice, and they are not tailored to your circumstances. No client, professional or advisory relationship arises from your reading them.

This material touches on areas that change regularly, including loan eligibility and margin of finance, mortgage protection products such as MRTA and MLTA, stamp duty, Real Property Gains Tax, foreign ownership thresholds and state consent requirements in Penang, and government schemes and exemptions. Each guide states the date on which it was last reviewed. Information is believed correct as at that date only. We are under no obligation to update it, and you should not assume that it reflects the position today.

Before acting on anything you read here, please take advice from your own solicitor, licensed tax agent, banker or other qualified professional.

7. Submitting a property through New Listing

If you submit a property to us through the website, you confirm that you are the registered owner of that property or that you are duly authorised by the registered owner to offer it for sale or letting, and that the information and images you provide are accurate and do not infringe the rights of any third party.

You grant us a non-exclusive, royalty-free licence to use, reproduce, edit, format and publish the information and images you supply for the purpose of marketing the property, on the website and on our associated channels and property portals. You may withdraw that licence by writing to us, and we will remove the material within a reasonable period, though copies may persist in search engine caches and third-party portals outside our control.

Submitting a property does not oblige us to list, market or accept it, and we may decline, edit or remove any submission at our discretion and without giving reasons. Submission does not appoint us as your estate agent. Any appointment, together with the terms of that appointment, is dealt with separately as set out in Section 9.

8. Favourites, shortlists and enquiries

The favourites feature lets you save listings and send a shortlist to us through WhatsApp. When you do so you leave the website and enter a service operated by Meta, whose own terms and privacy practices then apply. Saved favourites may be stored locally in your browser and may be lost if you clear your browser data, change device or use private browsing. We do not guarantee that a shortlist will be retained.

Enquiries, shortlists and viewing requests are handled during business hours and we do not guarantee a response within any particular time. Please do not use the website or WhatsApp to send anything urgent or time critical.

9. No agency relationship

Browsing the website, saving favourites, sending a shortlist, requesting a valuation, subscribing to our newsletter or making an enquiry does not appoint us as your estate agent and does not create any contract for services between us.

An estate agency relationship arises only when a written authority to act or agency agreement is signed by you and by us, in the form required under the Malaysian Estate Agency Standards. Until that point we owe you no agency duty. Where we market a property, we generally act for the vendor or the landlord, and you should assume that this is the case unless we have told you otherwise in writing. Professional fees, where payable, are governed by the Malaysian Estate Agency Standards and are set out in the relevant signed agreement rather than on the website.

10. Newsletter and marketing

If you subscribe to our newsletter, you consent to receiving property updates and marketing from us. You may unsubscribe at any time using the link in any message or by writing to us, and we will action it without charge. How we handle your personal data is set out in our Privacy Policy and Personal Data Protection Notice, which forms part of these terms.

11. Acceptable use

You may use the website for your own personal, non-commercial purposes and for genuine property enquiries. You must not:

  • copy, reproduce, republish, distribute or commercially exploit any part of the website or its content without our prior written consent;
  • use any robot, spider, scraper, crawler or other automated means to access, monitor, index or extract listings, images, prices, transacted data or any other content, or attempt to compile, reconstruct or resell any part of our listing database;
  • use any contact details, owner information or enquiry channel found on or through the website to solicit business, canvass for listings, market competing services or send unsolicited communications;
  • submit false, misleading or fraudulent enquiries, or impersonate any person or misrepresent your authority to act for an owner;
  • introduce any virus, malicious code or other harmful material, or attempt to gain unauthorised access to the website, its servers or any connected system;
  • use the website in any way that breaches any applicable law, infringes the rights of any person or interferes with its operation or with another user’s use of it.

We may suspend or withdraw your access to the website without notice if we reasonably believe you have breached this section, and we reserve our rights to take further action.

12. Intellectual property

All content on the website, including the Two Door name and logo, text, copy, guides, photographs, videos, floor plans, graphics, layout and design, is owned by us or by our licensors and is protected by copyright, trade mark and other intellectual property laws. Photographs and materials relating to individual properties may belong to owners, developers or photographers who have licensed them to us for marketing purposes only.

You may view the website and print or download extracts for your own personal, non-commercial reference. All other use requires our prior written consent. Nothing on the website transfers any right, title or interest in our intellectual property to you.

13. Third-party links and platforms

The website links to third-party websites and services, including property portals, developer websites, government and regulatory sources cited in our guides, and social media and messaging platforms such as WhatsApp, Instagram, Facebook and YouTube. Those links are provided for convenience only. We do not control, endorse or accept responsibility for the content, accuracy, availability, security or practices of any third-party site or service, and your use of them is governed by their own terms.

14. Availability of the website

We aim to keep the website available but we do not guarantee that it will be uninterrupted, error free, secure or free of viruses. Access may be suspended, restricted or withdrawn at any time, with or without notice, including for maintenance, upgrades or reasons outside our control. The website is provided on an “as is” and “as available” basis.

15. Personal data

Personal data collected through the website is handled in accordance with our Privacy Policy and Personal Data Protection Notice, issued under the Personal Data Protection Act 2010 as amended by the Personal Data Protection (Amendment) Act 2024. Please read it together with these terms.

16. Anti-money laundering and our right to decline

As a registered real estate firm we are a reporting institution under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001. We are required to carry out customer due diligence, to verify identity and source of funds where applicable, and to report certain transactions. We may decline to act, or cease to act, where we are unable to complete those checks to our satisfaction or where we are required or entitled to do so by law, and we may be unable to tell you the reason.

17. Limitation of liability

Nothing in these terms limits or excludes our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be limited or excluded, including under the Consumer Protection Act 1999.

Subject to that, and to the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the website, or from your reliance on any content on it. This includes loss of profit, loss of opportunity, loss of anticipated savings, loss of data, wasted expenditure and any indirect or consequential loss, however arising.

Subject to the first paragraph of this section, our total aggregate liability arising out of or in connection with the website and these terms is limited to one thousand Ringgit Malaysia (RM1,000). This limit does not apply to any transaction in which we have been formally appointed under a signed agency agreement, where liability is governed by that agreement and by the Malaysian Estate Agency Standards.

18. Indemnity

You agree to indemnify us against any claim, loss, liability or reasonable cost we incur arising from your breach of these terms, from your misuse of the website, or from any information or images you submit to us that are inaccurate, unauthorised or infringe the rights of a third party.

19. General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure or delay in enforcing any provision is not a waiver of it. These terms, together with our Privacy Policy and Personal Data Protection Notice, form the entire agreement between us in relation to your use of the website. You may not transfer your rights under these terms. Nothing in these terms confers any right on any third party.

20. Governing law and jurisdiction

These terms and any dispute arising out of or in connection with them or with your use of the website are governed by the laws of Malaysia. You and we submit to the exclusive jurisdiction of the courts of Malaysia, and the parties agree that proceedings shall be commenced in Pulau Pinang.
